ABP Measuring Control Systems Import Marketing Ltd. Şti. takes the highest possible security measures to ensure the lawful collection, storage, and sharing of your personal data and to protect your privacy.

Our goal is to provide you with the most transparent information regarding the collection, processing purposes, the parties to whom your personal data is shared, the legal grounds, and your rights, in accordance with Article 10 of Law No. 6698 on the Protection of Personal Data and to ensure your satisfaction.

a) Data Controller

In accordance with Law No. 6698 on the Protection of Personal Data (“Law No. 6698”), your personal data will be collected and processed by ABP Measuring Control Systems Import Marketing Ltd. Şti. (“COMPANY”), acting as the data controller, within the scope described below.

b) Purposes for Processing Personal Data

The COMPANY may collect personal data from parties such as customers, employees, potential customers, job candidates, business partners, and suppliers in categories such as identity information, contact information, customer information, customer transaction information, transaction security information, legal process and compliance information, and marketing and sales information.

Your collected personal data:

– To provide you with the COMPANY’s products and services, fulfill our obligations to you, maintain records and documents, and comply with information storage, reporting, disclosure, tax, and other obligations stipulated by local and international legislation.

– To offer you personalized advertising, campaigns, advantages, and other benefits for sales and marketing activities aimed at improving the quality of services and products.

– To manage infrastructure and commercial activities and comply with internal policies and procedures, including those related to auditing, finance and accounting, billing and collections, IT systems, data and website hosting, business continuity and records, and document and print management.

– To communicate with you regarding IT needs, system structure, the necessity of IT support services received, and to provide you with necessary information regarding these services and products.

– To conduct traffic measurement, statistical analysis, segmentation/profiling, and CRM activities for sales and marketing activities.

– To measure and increase customer satisfaction, manage complaints, and receive your opinions and suggestions regarding new services and products. To receive your problem and error reports, to inform you about products and services, complaints, and requests.

– To take your orders, to process your payments, to establish logistics partnerships with third parties and ensure product shipment, to recommend products and services that may be of interest to you, to conduct online behavioral advertising and marketing, customer portfolio management, to measure and improve service quality, to communicate, optimize, audit, risk management and control, to promote, analyze, identify areas of interest, to score, to profile, to market, to sell, to advertise, to communicate.

– To use your personal data in all products and services offered to you within the scope of the law and relevant legislation governing the transactions outlined in the COMPANY’s articles of association, which are subject to your disclosure to the COMPANY.

– To comply with information storage, reporting, and information obligations stipulated by official institutions, to fulfill the requirements of contracts, and to fulfill the legal obligations to which the COMPANY is subject regarding the use of these services.

– To determine and implement the COMPANY’s commercial and business strategies; The COMPANY will process financial operations, communications, market research, and social responsibility activities, purchasing operations (requests, offers, evaluations, orders, budgeting, contracts), internal system and application management operations, and legal operations.

– Personal data will be processed in accordance with the personal data processing conditions and purposes specified in Articles 5 and 6 of Law No. 6698 for the purposes of complying with applicable laws and regulatory obligations (including those outside your country of residence), including anti-money laundering and anti-terrorism laws, complying with legal processes, and reviewing, evaluating, and responding to requests from official and government authorities (including those outside your country of residence).

 

c) To Whom and For What Purposes Can Processed Personal Data Be Transferred

Your collected personal data will be used, limited to the fulfillment of the purposes specified above;

– To the COMPANY’s business partners, suppliers, shareholders, and affiliates,

– Tax Procedure Law, Social Security Institution regulations, Court of Accounts, Law on Prevention of Laundering Proceeds of Crime, Law on Prevention of Money Laundering, Turkish Commercial Code, Law of Obligations

This data may be transferred to individuals or organizations permitted by this and other legislative provisions,

– Legally authorized public institutions and organizations, administrative authorities, and legal authorities,

– Foreign companies and their affiliates,

– Natural or legal persons from whom we receive services and collaborate for product/service comparison, analysis, evaluation, advertising, and the achievement of the aforementioned purposes, program partner institutions and organizations, institutions with which we have agreements for sending messages to our customers, and cargo companies that deliver your orders, in accordance with the personal data processing conditions and purposes specified in Articles 8 and 9 of Law No. 6698.

 

ç) Method and Legal Reason for Collecting Personal Data

Your personal data is collected verbally, in writing, or electronically through channels such as the COMPANY’s Head Office, through applications submitted through contracted websites, other institutions from which we provide/receive support services, and from real and/or legal entities with whom we conduct transactions under any legislation or contract, our website and mobile application, our call centers, and our social media accounts, or through other channels that may be established in the future.

The data is collected by the COMPANY for the purposes specified above, within the scope of the performance of the contract, within the framework of legal regulations.

 

d) Rights of the Personal Data Owner Enumerated in Article 11 of Law No. 6698

As personal data owners, if you submit your requests regarding your rights through the methods specified below, the COMPANY will respond to the request as soon as possible and within thirty days at the latest, depending on the nature of the request. No fee will be charged for responses up to ten pages. A processing fee of 1 Turkish Lira will be charged for each page exceeding ten pages. If the response to the application is provided on a recording medium such as a CD or flash drive, the fee our company may charge will not exceed the cost of the recording medium.

In this context, personal data owners;

  • To learn whether personal data has been processed,
  • To request information if personal data has been processed,
  • To learn the purpose of processing personal data and whether it is being used in accordance with its intended purpose,
  • To know the third parties to whom personal data has been transferred, both domestically and internationally,
  • To request correction of personal data if it is incompletely or incorrectly processed, and to request notification of the action taken to third parties to whom personal data has been transferred,
  • To request the deletion or destruction of personal data if the reasons requiring processing no longer exist, despite the data having been processed in accordance with the provisions of Law No. 6698 and other relevant laws, and to request notification of the action taken to third parties to whom personal data has been transferred,
  • To object to the analysis of processed data exclusively through automated systems, resulting in a result detrimental to the person,
  • To claim compensation for damages in the event of damages arising from the unlawful processing of personal data. You have the right to request the removal of your personal data.

You may submit your request regarding the exercise of your rights specified above, in accordance with Article 13, Paragraph 1 of Law No. 6698 and the Communiqué No. 30356, dated March 10, 2018, on the Procedures and Principles for Applications to the Data Controller, in Turkish, in writing, or by using a registered electronic mail (KEP) address, secure electronic signature, mobile signature, or the electronic mail address previously notified to the COMPANY and registered in our system. Applications will only include information about the applicant; it will not be possible to obtain information about other family members or third parties. The COMPANY reserves the right to verify your identity before responding.

 

In your application, you must include:

a) Your name, surname, and signature if the application is in writing,

b) For citizens of the Republic of Turkey, your Turkish Republic ID number, Your ID number, if you are a foreigner, your nationality, passport number, or your ID number, if applicable.

c) Your residence or workplace address for notification.

ç) Your email address, telephone number, and fax number for notification, if applicable.

d) The subject of your request.

This information is mandatory, and any relevant information and documents must be attached to the application.

Depending on the nature of your request, we must provide you with complete and accurate information and documents that will enable identification. If the requested information and documents are not provided as required, the Company will be responsible for the verification of your identity.

KET may encounter problems in conducting the investigations based on your request in a complete and qualified manner. In such cases, COMPANY reserves its legal rights. Therefore, your application must be submitted in full and containing the requested information and documents, depending on the nature of your request.
